Keywords:
Islamic international law, compilation, sources, historical development, jurisprudential principlesAbstract
Islamic international law is a codified system of law that governs the principles of states, nations and international relations in light of Islamic Sharia. This paper aims to present a comprehensive and research-based review of the formulation of Islamic international law, its primary sources and historical evolution. The primary sources discussed in this study include the Holy Quran, the Sunnah of the Prophet, the sayings of the Companions, jurisprudential opinions and historical treaties. Research has indicated that Islamic international law is founded on universal principles like justice, peace, tolerance and respect for human beings, which comply with many fundamental concepts of modern-day international law. This article presents an analytical study of the stages of compilation and the jurisprudential and practical developments that took place during different periods, especially the Rightly Guided Caliphate, the Umayyads, and the Abbasid era. Research has concluded that Islamic international law not only exists historically as a structured legal system but its reinterpretation in the modern era can also play an important role in resolving the moral and legal crises of international relations.
